Mr. Swaim has been with Bordin Semmer since its inception. Mr. Swaim’s practice focuses on the representation of corporations and public entities in catastrophic personal injury and wrongful death matters in both state and federal court. Mr. Swaim represents clients in a wide range of practice areas, including complex litigation, trucking, general liability, and construction. Mr. Swaim has also represented plaintiffs in a number of high-exposure personal injury matters.

Representative Matters

  • Negotiated a favorable resolution on behalf of a large food company in a catastrophic personal injury matter involving six plaintiffs, where our client contributed no money to a 7-figure settlement;
  • Obtained summary judgment on behalf of a Southern California city in a high-exposure wrongful death matter;
  • Obtained summary judgment on behalf of a Southern California school district in a high-exposure personal injury matter involving allegations of negligent supervision;
  • Obtained summary judgment on behalf of a Southern California city in a personal injury and wrongful death matter involving allegations of a dangerous condition;
  • Obtained summary adjudication of a punitive damages claim in a federal wrongful death case on behalf of a prominent motocross company, which resulted in obtaining a favorable settlement for less than a tenth of the damages sought by plaintiffs;
  • Negotiated a nuisance-value settlement in a personal injury case on behalf of a prominent pop star following the filing of a Motion for Summary Judgment;
  • Obtained several dismissals of cities and school districts in a number of personal injury matters based on Government Tort Claims defenses;
  • Obtained several six-figure settlements on behalf of injured plaintiffs, including a large settlement against a prominent airline.

Work History & Background

Mr. Swaim is a graduate of Southwestern Law School’s two-year SCALE program, where he was a member of the Trial Advocacy and Moot Court Honors Programs. As a trial advocate, Mr. Swaim was selected as “Best Overall Advocate” at the Bonelli Trial Advocacy Competition. Mr. Swaim was also privileged to present oral arguments in front of three federal judges at the Jerome Prince Evidence Competition in New York, where his Moot Court team placed second in the nation. Following graduation, Mr. Swaim completed a prestigious fellowship with the Los Angeles Chapter of the American Board of Trial Advocates (ABOTA).
